Homes MSP Real Estate Blog: Waiting periods after foreclosures ...

Mortgage companies will require a time period to show re-established credit after things like a bankruptcy, foreclosure and short sales.? The time periods will vary based on the type of loan and the type of derogatory item.

For conventional loans, the time period for most banks are:

  • ????Foreclosure - 7 years from the date the foreclosure was completed.? If there were extenuating circumstances and you have a 10% down payment, you may be allowed to get a new mortgage after 3 years.
  • ????Short Sale or a deed in lieu of foreclosure - 7 years from the date the sale closed and transferred to the new owner for less than 10% down.? 4 years from date sale closed with a 10% down payment.? 2 years from date sale closed with 20% down.?
  • Bankruptcy - Chapter 7 requires 4 years from date of discharge.? If there are extenuating circumstances, it may be as little as 2 years.? A chapter 13 requires 2 years from discharge date.

FHA time periods are:

  • Foreclosure - 3 years from the date the foreclosure was completed.?
  • Short sale - 3 years from the date the sale closed and transferred to the new owner.? No waiting period if the borrower had no late payments and they are not taking advantage of declining market conditions
  • Bankruptcy - Chapter 7 requires 2 years from the date of discharge.? A Chapter 13 requires 1 year of payback and all required payments on time.

VA time periods:

  • Foresclosure - 2 years from the date foreclosure was completed and transferred back to the bank
  • Short Sale - 2 years from date closed and transferred to the new owner.? No waiting period if the borrower had no late payments within 12 months of the sale and they are not taking advantage of declining market values.
  • Bankruptcy - Chapter 7 requires 2 years from date of discharge.? Chapter 13 requires 1 year of payback with all payments on time.

If? you have filed a bankruptcy or had a foreclosure, you will be able to get a new mortgage, it's just a matter of time.? The most important thing is to remember to re-establish new credit and not to have any late payments after the bankruptcy or foreclosure.

(AP Photo/The Charlotte Observer, Robert Lahser)

(AP) ? When Latonya Stevens heard thunder and lightning in the distance, she knew the drill. Every time a storm drew near, her children would run to her room seeking comfort.

So Stevens turned on a hall light for the young kids as high winds began buffeting the house. Then she blacked out and awoke to find only one of the four children in sight and the house ripped apart.

She quickly assumed the worst: that a twister had carried off the other three kids.

"I was screaming for them," Stevens said Monday. "I was panicking. For a moment, I didn't know where they were."

No one knows precisely what happened, but this much is clear. The three children were in their rooms when the tornado approached. As the winds rose, most of the home's second floor was swept away. After the storm passed, the kids were found outside on the ground, one of them 100 feet away along a major highway.

All three emerged with only cuts and bruises ? and a story to tell for the rest of their lives.

"It's a miracle they survived," said their grandfather, Clarence Gray Jr. "God was looking out for them."

Most of the family's possessions were lost. But by Monday, the children were playing in their grandparents' house if nothing had happened.

They picked up family photos scattered on a coffee table. "This was our house," Jamal said, pointing to a picture.

The children ? 3-year-old Amber, 4-year-old Ayanna and 7-year-old Jamal ? said they don't recall anything.

"They're like me. They don't remember what happened," Stevens said. "We don't know. Maybe it will come back to us eventually. I mean, I've sat down and tried to figure out what happened. I don't know," she said softly.

When storms moved into the Charlotte area late Friday, the four children were upstairs in their bedrooms. Their grandmother, Patricia Stevens, was watching TV downstairs on a couch. Their father, Tyrone Stevens, was out with friends who were in town for a basketball tournament.

The noise awoke the children, who initially went to their mother's room where they watched a Disney movie. When the storm died down, they returned to their beds.

But a half-hour later, Stevens heard a new storm approaching and got up to take care of the children. As she turned on the hall light, the house began to shake and the wind started to howl.

Then she lost consciousness.

Stevens awoke in the dark holding the other 3-year-old twin, Ashley, and shouting for her children. The roof was gone. Only then did she realize that her house had been struck by a tornado.

She hurried downstairs in the dark, screaming "Where's my babies," and spotted her mother who also was frantic.

"I didn't know where the children were," Patricia Stevens said. "The house was shaking, and then we heard the noise. And all of the sudden you heard the house go whap, whap, whap, whap. Just like that. Then the walls were gone. Then I said to myself, 'Is this how you're supposed to die? Are we going to die in here or what?'"

Stevens handed Ashley to the girl's grandmother while she started searching outside for her children. Neighbors began searching, too.

Sheena Redfearn and her husband, Chris, heard Stevens shouting from four doors down the street.

After the couple was sure their own children were safe, Chris Redfearn bolted outside with a flashlight and began following Jamal's voice, leaping over fences in the search for the boy.

Amber was found in the family yard under some debris. Ayanna landed in a neighbor's yard. Jamal had been tossed more than 100 feet.

The children were rushed to the hospital. Tyrone Stevens, who was contacted by family, headed to the hospital, too.

When he returned to his house the next day, he couldn't believe what had happened.

"Just looking at it, it just shook me to my core," he said. "I was devastated. Thank God everyone is OK."

The stories bring to mind a Tennessee boy who was thrown into a muddy field northeast of Nashville during a Feb. 5, 2008, tornado that killed his mother. Then just a year old, Kyson Stowell-Noble, was found face-down in a rural field strewn with splintered lumber, couches and toys. He was about 100 yards from his mother, who was one of 59 people killed when a string of tornadoes slammed five Southern states.

Kyson needed just two days of hospital treatment for scrapes and a collapsed lung.

Now when bad weather approaches, Kyson likes to go outside. He even did so during the epic storms Friday that killed 40 people across the Midwest and South.

"He put on his clothes and went outside to see what was going on," his grandmother, Kay Stowell, said by telephone Monday.

Meanwhile, the Stevens family said they would love to rebuild in the same neighborhood.

"My neighbors were there for me, and those are the kind of people I want to be around," Latonya Stevens said. "It's a big family."

But first the family must confront the trauma of the storm.

"Every time I close my eyes, I still see it," she said. "I haven't had time to deal with it. I sleep on and off. I'm more worried about the kids and how they're feeling."

Melting sea ice could trigger colder winters

Arctic sea ice is continuing its seemingly interminable decline, and it looks like the loss could be contributing to the recent spate of cold winters over northern Europe and North America.

Researchers are still unsure about how important sea-ice loss is to winter weather. The fluctuating weather that Europe and the Americas have experienced since December last year is a reminder that many different factors are at play.

Jiping Liu at the Georgia Institute of Technology in Atlanta crunched data on ice and weather from the last three decades and found a link between the extent of Arctic sea ice and cold, snowy winters in the regions immediately to the south.

"The study adds weight to growing belief that Arctic sea ice is driving an increase of cold winters," says Adam Scaife of the UK Met Office. His team has also found evidence to support such a link.

Open water

It is well established that the dramatic loss of winter sea ice in the Arctic has caused it to feel global warming more sharply than the rest of the planet. Less ice means more exposed water, which ? being darker than ice ? absorbs more solar energy. To compound things, with less ice to insulate the warmer ocean from the air above, more of that energy is released back into the atmosphere as heat.

The net result is that Arctic air is significantly warmer than before. Some years, winter temperatures have reached 4 ?C above average ? an enormous difference.

Things get a bit messier when figuring out how this affects the weather further south. When the Arctic winter is warmer ? and there's less of a contrast between temperatures at the pole and in the tropics ? the jet stream tends to creep south and lose some of its strength. This is known as a "negative Arctic oscillation". During these negative phases, the jet stream blows warm weather in over the Mediterranean and allows cold, dry Arctic air to rush in over the northern continents.

Solar cycles

But while Liu's research strengthens the case for a strong link between sea ice and the negative Arctic oscillations that encourage extreme winters, Scaife and others point out that it is just one factor among many.

A case in point, this winter started out quite mild. The Arctic oscillation only flipped into a negative phase in mid-January, triggering cold spells that killed hundreds of people in eastern Europe and Asia. This suggests other factors are at play.

James Overland of the Pacific Marine Environmental Laboratory in Seattle believes the weather we have seen in the past few months is largely down to natural variations. "There are other factors besides sea-ice anomalies that influence winter snowfall," agrees Liu. They include the El Ni?o/La Ni?a cycle and the roughly-decadal variations in the solar activity. El Ni?o and solar minima both bring cold winters.

Balancing act

The big challenge now is to integrate everything we know about the different factors into one big model, to figure out how they all play out together. "If it were down to the sun alone, we would be heading from colder winters to milder ones on average," says Scaife ? because solar activity is on the rise right now.

But Liu's results show that decrease in Arctic ice cover will have the opposite effect. How the two factors will balance out in the short term is impossible to say.

In the long term, solar activity will continue to cycle up and down, but we expect ice to keep melting. "If you're looking 30 years ahead, when Arctic will be closer to 80 per cent ice-free rather than 30 or 40 per cent. We can expect to see colder winters," says Overland.

Oil leaking from ship three months after New Zealand grounding

Anger growing over Rena oil spill in New Zealand.

Wellington (dpa) ? A 47,000-ton container ship was leaking oil and spilling cargo on beaches Friday, three months after running aground on a New Zealand reef.

Clean-up teams mopped up oil on two of the North Island?s most popular beaches and collected cargo, including meat, washed up on the shore from the Rena?s broken containers, the Maritime New Zealand agency said in a statement.

One oil-covered penguin was rescued to be cleaned, the latest victim of the country?s worst marine environmental disaster.

More than 2,000 seabirds have died and nearly 400 oil-contaminated little blue penguins cleaned since the Rena ran aground 22 kilometers off the east coast port of Tauranga on October 5.

The Rena leaked about 360 tons of heavy fuel oil after grounding, and salvage teams managed to siphon off more than another 1,000 tons, but Maritime New Zealand commander Rob Service said before Christmas, ?We know there is still oil on the wreck that the salvage team can?t reach. We are ready to launch another large scale-response if and when that oil is released.?

The agency reported Friday a ?light oil sheen? extending up to 2.5 kilometers from the vessel and dispatched clean-up teams to the suburban Papamoa and Mount Maunganui beaches, which would normally be packed with holidaymakers at this time, the height of summer.

Heavy rain and strong winds were sweeping the area, however, keeping the crowds off the sand and stopping the salvage operation to remove the 985 containers still on board.

The Filipino captain and navigation officer of the Liberian-flagged Rena spent Christmas in New Zealand on bail and awaiting trial on criminal charges related to the ship?s grounding, including operating a vessel in a manner causing unnecessary danger.
